Bike/Scooter/Skateboard Policy (Interim)

1.1.01 Purpose

To set forth the regulations that govern the operation and use of bicycles, motorized bicycles, electric bicycles, skateboards, electrically motorized boards, motorized scooters, and roller-skates on the campus of or on the property owned, operated or controlled by California State University, Bakersfield.

1.2.01 Authority

The authority to establish rules and regulations pertaining to the use of bicycles, motorized bicycles, electric bicycles, skateboards, electrically motorized boards, and roller-skates on a California State University campus is vested in the University President pursuant to Section 21113(f) of the California Vehicle Code and Title 5, Article 9, Section 42353.1(a) of the California Code of Regulations.

Motorized scooters are regulated under California Vehicle Code Section 21235.

Medical mobility devices and police mobility devices are exempt under this policy.

1.3.01 Definitions

1.3.02 “Bicycle” means a device propelled by human power upon which a person may ride having two tandem wheels either of which is more than 12 inches in diameter, with steering capability and brakes which operate on or upon the wheels. It also includes any device generally recognized as a bicycle, although equipped with more than one front or rear wheel.

1.3.03 “Motorized bicycle” means a two- or three-wheeled device, capable of no more than 30 MPH on level ground, and equipped with: Fully operative pedals for human propulsion. A motor producing less than four gross brake horsepower and an automatic transmission.

1.3.04 “Electric bicycle” means a bicycle equipped with fully operable pedals and an electric motor of less than 750 watts.

1.3.05 “Skateboard” means a non-motorized device consisting of two or more wheels affixed to a platform or footboard upon which a rider stands and which does not have steering capability similar to that of a bicycle or brakes which
operate on or upon wheels of the skateboard. It also includes every device generally recognized as a skateboard.

1.3.06 “Electrically motorized boards” means a wheeled device with a floorboard for standing, measuring no more than 60 inches deep and 18 inches wide, designed for one person, and powered by an electric motor averaging less than 1,000 watts. The board must have a maximum speed of 20 MPH on a paved level surface when powered solely by its propulsion system.

1.3.07 “Roller-skates” means a device consisting of a shoe with one or more wheels attached for skating or a metal frame with wheels attached that can be fitted to a shoe worn by a person. It includes in-line skates, rollerblades and every device generally recognized as roller-skates.

1.3.08 “Motorized scooter” means any two-wheeled device that has handlebars, has either a floorboard that is designed to be stood upon when riding or a seat and footrests in place of the floorboard, and is powered by an electric motor. This device may also be designed to be powered by human propulsion.

1.3.09 “Scooter” means a non-motorized device consisting of two or more wheels affixed to a platform or footboard upon which a rider stands and which has a handle or other mechanism for holding or guiding the device. It also includes every device generally recognized as a scooter. For the purpose of these regulations mopeds and motorcycles are considered motor vehicles.

1.3.10 “University property” means the university campus and any other property owned, operated or controlled by California State University, Bakersfield.

1.4.01 Policy

1.4.02 Bicycles

a. Unless otherwise provided by regulations or traffic signs, bicycles may only be ridden upon roadways and sidewalks, except that where a bicycle path has been provided adjacent to a roadway or sidewalk, bicycle riders shall use such bicycle path.

b. Bicycles shall not be ridden upon any ramp, stairway, wall, bench, fountain, or other structure or facility or on or over shrubbery, grass, or flower beds. Bicycles shall not be ridden within any building or parking lot except as part of a university approved competition or function.

c. Every person riding a bicycle shall yield the right of way to pedestrians at all times.

d. Every person riding a bicycle shall exercise due care and reasonable caution to prevent injury to others, to self, or to property. Obstacle riding or other acts or maneuvers which may endanger the bicycle operator or others or damage property is prohibited.

e. No person riding a bicycle shall exceed a reasonable and proper speed under the circumstances then and there existing. In no event shall any person ride a bicycle at a speed greater than 10 miles per hour upon any sidewalk or pedestrian pathway except as part of a university approved competition or function.

f. No person riding a bicycle shall attach the same in any manner to any moving vehicle. This shall not prohibit the attachment to a bicycle of a bicycle trailer or semitrailer specifically designed for such attachment.

g. Bicycles shall not be ridden two or more abreast on any sidewalk or pedestrian walkway, except as part of a university approved competition or function.

h. No person shall ride a bicycle upon or along a sidewalk, pedestrian walkway, or across a roadway where the riding of bicycles is prohibited by official traffic control devices or signs, except as part of a university approved competition or function.

i. No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped, except that an adult rider may carry a child securely attached to his/her person in a backpack or sling or in a child carrier securely attached to the bicycle.

 j. No person riding a bicycle shall carry any package, bundle, or other article which may prevent the operator from keeping at least one hand on the handlebars.

k. Every bicycle shall be equipped with such brakes, reflectors, and other safety devices as is required by State law for operating a bicycle on streets or highways.

l. Bicycles shall not be parked on or at ramps, entrances or other facilities designated for persons with physical disabilities or in such a manner as to impede the free and clear use of such facilities.

m. Bicycles shall not be parked in the public areas of any building, including but not limited to hallways, stairwells, and classrooms. Bicycles shall not be parked at or near any building entrance or exit in such a manner as to impede the free and clear use of such areas.

n. Bicycles shall not be parked at or attached to any fire hydrant, standpipe, building service equipment or other safety device.

o. State traffic laws pertaining to bicycles are in full force and effect on university property.

1.4.03 Skateboards, Scooters and Rollerskates

a. Unless otherwise provided by regulations or traffic signs, skateboards, scooters, roller-skates, and motorized boards may only be ridden upon roadways, the bike path, or upon designated routes in the campus interior. The designated routes are as follows:

          1. From the Don Hart West turn-around, south on the Red Brick Road to the turn-around at the east end of Student Way.

          2. From the Student Way turn-around, south on the sidewalk/emergency road between Science III and the Business Development

          Center to Rowdy Way.

          3. From the Student Way turn-around, east on the service road, then south (Roadrunner Drive extension) to the turn-around in front

          of the Icardo Center.

          4.  Access path between Student Housing East and Don Hart East

          5. Any marked bike path within campus

b. Skateboards, scooters, roller-skates, and motorized boards shall not be ridden or used upon any sidewalk not authorized by this policy. Except as part of a university approved competition or function, skateboards, roller-skates, and motorized boards shall not be ridden or used in any parking lot.

c. Skateboards, scooters, roller-skates, and motorized boards shall not be ridden upon or used on any ramp, stairway, wall, bench, fountain, or other structure or facility or on or over any landscaped area, including, but not limited to, grass, shrubbery, or flower beds. Skateboards, roller-skates, and motorized boards shall not be ridden or used within any building or parking lot.

d. Every person riding a skateboard, scooter, motorized board, or using roller-skates shall yield the right of way to pedestrians at all times.

e. Every person riding a skateboard, scooter or motorized board or using roller-skates shall exercise due care and reasonable caution to prevent injury to others, to self, or to property.

f. No person riding a skateboard, scooter or motorized board or using roller-skates shall exceed a reasonable and proper speed under the circumstances then and there existing and in no event shall any person riding a skateboard or motorized board or using roller-skates exceed a speed of 10 miles per hour upon any path or roadway except as part of a university approved competition or function.

g. Skateboards, scooters, motorized board riders and roller-skate users shall not engage in obstacle riding or other acts or maneuvers which may endanger the rider or others or which damage property.

h. Skateboards, scooters, roller-skates, and motorized boards shall not be left unattended on or at ramps, entrances or other facilities designated for people with physical disabilities or in such a manner as to impede the free and clear use of such facilities.

i. Skateboards, scooters, roller-skates, and motorized boards shall not be left unattended in the public areas of any building, including but not limited to hallways, stairwells, and classrooms. Skateboards, roller-skates,
and motorized boards shall not be left unattended at or near any building entrance or exit in such a manner as to impede the free and clear use of such areas.

j. All state laws pertaining to skateboards, scooters, roller-skates, and motorized boards are in full force and effect on university property.

1.5.01 Motorized Scooters

a. All people riding a motorized scooter on campus shall abide by California Vehicle Code Section 21235 which states:

The operator of a motorized scooter shall not do any of the following:

          (a) Operate a motorized scooter unless it is equipped with a brake that will enable the operator to make a braked wheel skid on dry,

          level, clean pavement.

          (b) Operate a motorized scooter on a highway with a speed limit in excess of 25 miles per hour unless the motorized scooter is

          operated within a Class II or Class IV bikeway, except that a local authority may, by ordinance or resolution, authorize the operation

          of a motorized scooter outside of a Class II or Class IV bikeway on a highway with a speed limit of up to 35 miles per hour. The 15

          mile per hour maximum speed limit for the operation of a motorized scooter specified in Section 22411 applies to the operation of

          a motorized scooter on all highways, including bikeways, regardless of a higher speed limit applicable to the highway.

          (c) Operate a motorized scooter without wearing a properly fitted and fastened bicycle helmet that meets the standards describe in

          Section 21212, if the operator is under 18 years of age.

          (d) Operate a motorized scooter without a valid driver’s license or instruction permit.

          (e) Operate a motorized scooter with any passengers in addition to the operator.

          (f) Operate a motorized scooter carrying any package, bundle, or article that prevents the operator from keeping at least one hand

          upon the handlebars.

          (g) Operate a motorized scooter upon a sidewalk, except as may be necessary to enter or leave adjacent property.

          (h) Operate a motorized scooter on the highway with the handlebars raised so that the operator must elevate his or her hands

          above the level of his or her shoulders in order to grasp the normal steering grip area.

          (i) Leave a motorized scooter lying on its side on any sidewalk, or park a motorized scooter on a sidewalk in any other position, so

          that there is not an adequate path for pedestrian traffic.

         (j) Attach the motorized scooter or himself or herself while on the roadway, by any means, to any other vehicle on the roadway.

1.5.01 Enforcement

a. Violations of certain sub-sections of these regulations may result in temporary seizure of the bicycle, skateboard, or roller-skates.

b. Failure to follow these regulations may result in criminal action pursuant to California Vehicle Code Section 21113(f), California

 c. Vehicle Code Section 21235, and/or referral to the Office of the Dean of Students.
Per University Police Department policy, all CSUB Police Officers are expected to enforce traffic laws.
